According to the United States Citizenship and Immigration Services (USCIS), the EB-5 program has been a boon for the US economy especially areas suffering from chronic employment. It has led to investments over $8.7 billion since 2012 and helped create more than 35,000 jobs.
But with Trump era beginning and Congress hardening its stance towards immigration, it comes as no surprise that major changes are being planned in the EB-5 visa regime.

The EB-5 green card program was started in 1990 by the U.S. Congress to stimulate the economy. EB-5 visa offers foreign nationals a direct path to Green Card if a person invests $500,000 US dollars and along with that investment creates ten new full-time jobs for United States citizens or other legal residents.
Once the EB 5 visa requirements are met, the foreign nationals can attain a provisional residency after two years and once the investment is made as per EB-5 guidelines, the foreign nationals will be eligible to become a naturalized US citizen after five years.
More importantly, the investment is not only for the investor but his spouse and unmarried children under the age of 21. So not only you get to invest in the lucrative American market, your entire family gets that coveted citizenship.
### WHY DO YOU NEED TO TAKE A DECISION ON EB-5 TODAY?
#### **1. The increase in capital investment:**
Department of Homeland Security has initiated a proposal to increase the investment criterion from $500,000 to $1.35 million. Interestingly, this was done a week before Trump’s inauguration. Donald Trump and his real estate empire have benefitted a lot from the EB-5 investment scheme and as such, there is no risk of the program being discontinued. But his rhetoric on immigration would tie his hands and a major increase in capital requirement seems to be a given.
For an investor looking to take a long-term plunge, this is a perfect time. Not only you avoid a 170% increase in your capital outlay but also are investing in an economy which has recovered from the economic recession and is poised to grow aggressively in the coming decade as Trump facilitates businesses to function at full steam. #### **2. H-1B Visa Issues:**
Recent proposed amendments to the H1-B visa rules will shatter the dreams of many foreign nationals who wish to work in the U.S. The bill introduced in the US Congress makes it increasingly onerous for companies in the U.S. to employ skilled foreign workers. Bill has more than doubled the benchmark for salary level; the minimum wage requirement is poised to increased to $ 130,000 for H1-B visa holder which was $60,000 earlier.
The struggle does not end there because the quota restrictions and other complications in the H1-B regime have lowered the chances of getting the visa. Even then it is a 10-year wait for you to get that coveted Green Card.

Only 10,000 EB-5 visas are issued each year under the scheme and these visa numbers include not only the foreign investor but also their family members (that include the spouse and all unmarried children under the age of 21).
The popularity of EB 5 visa is evident as 2,941 applicants applied for EB-5 in the first quarter of 2015 while the applications almost doubled to 6,277 in the first quarter of 2016. The last quarter of 2016 witnessed a surge in a number of visa filings, thus increasing the already huge pool of pending applications and now this number is expected to increase further.
It is important to get in this queue and fast. You do not know when they will stop accepting applications under the old criteria and it is vital for your future to not gamble with whether you will be able to get through the old regime.
